Unless otherwise directly specified in quote or contract, the work proposed by Can’t Be Beat Fence and Construction, LLC (CBBFC) in its estimate shall be subject to the following terms, conditions and limitations:
- CBBFC provides a quote on estimated footage and quantities. Final pricing shall depend on final footage and quantities installed. Owner shall field verify estimated quantities prior to acceptance of estimate. Quote is valid for 14 days due to fluctuating material prices. Please call for price check after 14 days.
- Quote does not include any clearing, grubbing, leveling or other site work. Fence line must be acceptably free of vegetation, debris and outbuildings prior to work. Dips in ground may create gaps under fence. Underground obstacles (i.e. buried slabs and stumps) may prevent work. Core drilling and plated posts always incur extra charges.
- CBBFC will initiate a Mississippi or Louisiana “811 One Call” to locate utilities at no charge. This locate must be performed before work can be begin and owner of property must cooperate in allowing access for CBBFC and utility agents to mark the property. CBBFC shall not be liable to owner for any direct or consequential damages as a result of any damaged utility or service line that was not properly marked by the agents of the utility. CBBFC is not responsible for marking or damaging of service lines not otherwise provided by the “811 One-Call” service (i.e. sprinkler lines). Owner agrees to use due diligence to locate and disclose the location of any such unmarked lines.
- Owner shall be solely responsible for ensuring that the requested product and line placement complies with local fence codes. (Consult your local building department, planning and zoning and/or HOA/POA). Owner is responsible for obtaining all construction permits unless governing agency specifically requires contractor to obtain permit. Permits obtained by CBBFC shall incur a fee and reimbursement for costs.
- CBBFC is not responsible for providing any drawings, blueprints, submittals or redlines of existing drawings of the work proposed to be performed. CBBFC shall provide installation in a manner consistent with generally acceptable industry practices. Any engineering required is to be provided by Owner. CBBFC does not provide a guaranteed wind load capacity of any fence.
- CBBFC provides a one-year warranty for installation workmanship except for no warranties on wood gates over 10’ wide. Material warranties are provided by manufacturers of metal, vinyl or wood products installed and vary by product.
- CBBFC does not provide any surveying services and Owner is responsible for fence location. CBBFC shall not be responsible or liable for any direct or consequential damages for fence placed on third party’s property and shall be held harmless by Owner from any claims of third parties. In the event CBBFC becomes aware that a third party is claiming ownership of property, CBBFC has the right to cease performance until the property issue is resolved and to immediately receive compensation for all work performed prior to work stoppage.
- CBBFC is not liable for direct or consequential damages for any drainage, erosion or water run-off issues caused by the installation of a fence.
- No grounding or electrical services included.
- The term “owner” shall mean the owner of the real property or the owner’s agent, owner’s contractor or other person with apparent authority to authorize work and bind the owner to these terms.
